Information on the Protection of Personal Data
This information text has been prepared by BORNOVA APART, acting as the data controller, within the scope of Article 10 of the Personal Data Protection Law No. 6698 and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Information Obligation.
Your personal data held or to be held by BORNOVA APART (hereinafter referred to as the "Data Controller") are under the protection of the Data Controller, and as a matter of fact, the Data Controller takes the necessary measures with the necessary infrastructure and technological means to ensure the safe storage and legal processing of personal data within the framework of the Personal Data Protection Law No. 6698 (hereinafter referred to as the "Law").
Personal data may be processed by the Data Controller in accordance with the Law and related legislation in the circumstances specified below. This "Information Text" details the natural persons whose personal data is processed under the Law, the personal data that may be processed by the Data Controller in its capacity as data controller, the purposes for which such data may be processed, to whom and for what purposes it may be transferred, the method of acquisition, and the rights of the personal data owner.
I. Your Personal Data
Personal data refers to any information relating to an identified or identifiable natural person. According to the Labor Law No. 4857, the Data Controller processes the identity, contact, address, family and relationship, criminal record, visual, education, finance, personnel and health data of individuals who work based on an employment contract and whose personal data is obtained through employment relationships. The identity, contact, criminal record, visual, financial, personnel and health information of natural persons employed by subcontractors who receive work in a part of the main job or in auxiliary jobs within the scope of Law No. 4857 and of employees employed by suppliers with whom supplier contracts have been signed for the purpose of service provision; the identity, contact, visual, signature and financial information of subcontractors and suppliers; the identity, contact, criminal record, visual, financial, personnel and health information of natural persons doing internships within the scope of the Vocational Education Law No. 3308; the identity, contact, education and address information of employee candidates who have applied for a job through any means or have made their resume and related information available to our company for review; The company processes the identity, contact, address, visual and financial data of customers staying at the hotel; the identity, contact, financial and visual data of customers who only use the hotel restaurant; the identity, contact, address, financial and visual data of customers organizing events at the hotel; the identity, contact, address, visual and financial data of customers and staff; the identity, contact, address, visual and financial data of event participants; the identity information of third parties such as family members, relatives and former employees; and the identity and visual information of natural persons who are visitors who have entered the physical premises owned by the company for various purposes.
II. Purposes of Processing Your Personal Data
Fulfillment of legal obligations,
Carrying out corporate sustainability activities,
Management of relations with suppliers and subcontractors,
Carrying out personnel recruitment processes,
In order to be able to offer a new job to job applicants if a suitable position is found, their CVs and notes of interviews and reference inquiries conducted during the job application evaluation process must be kept for this purpose;
Making suggestions to you for changes in positions and duties of personnel based on their areas of interest and competence,
Providing job-related training to company personnel,
Carrying out internal audit and legal procedures,
Carrying out and developing corporate management and communication activities,
Planning and execution of marketing and sales operations,
Request and complaint management,
Providing information to authorized persons or organizations arising from legislation,
Ensuring security within the hotel,
Creating customer records,
To carry out various advertising and marketing activities,
Obtaining the data owner's opinion through surveys and votes,
Determining, customizing and developing appropriate products, projects and services for data owners,
Providing effective and complete service to customers,
Ensuring the security and order of events,
Creating and monitoring visitor records,
Sending catalogues or campaign messages to data owners,
Keeping the data up to date,
Transfer of data for storage,
Copying/backing up data to prevent data loss,
It may be processed for the purposes of storing your information that must be kept in accordance with legal legislation, backing up your information to prevent loss of information, taking all necessary measures for the security of your information, and similar purposes.
III. Transfer of Personal Data
The Data Controller may transfer your personal data to relevant persons and organizations at home and abroad within the scope of the relevant legal legislation in the following cases:
Your personal data may be transferred to the Data Controller and authorized persons acting on behalf of the Data Controller, to persons and companies with whom we will cooperate to provide technical maintenance services and data storage-server services, to our lawyers, auditors, consultants and other persons and companies from whom we receive services, to those authorized by you, to all other official institutions such as administrative and judicial authorities and other public institutions or organizations authorized to request your personal data within the scope of the identity notification law, and to the banks to which your salary and other payments will be made.
Your personal data may be shared with program partner institutions and organizations with which we cooperate in order to carry out our Data Controller activities, with domestic/overseas persons and organizations from whom we receive data storage services in the cloud environment, with domestic/overseas organizations with which we have agreements regarding sending commercial electronic messages that we send with permission, with survey companies within the scope of various marketing activities in order to provide better service, and with our relevant business partners to other domestic/overseas third parties in accordance with Articles 8 and 9 of the Law.
IV. Method and Legal Reason for Collecting Personal Data
The Data Controller processes your personal data for the purposes of establishing contracts such as service contracts, subcontracting contracts, purchase-sale contracts, accommodation contracts, event contracts, etc. and fulfilling contractual requirements and legal obligations, and also processes special personal data, provided that the person concerned has given his/her explicit consent for these legal reasons.
The personal data of the persons concerned can be obtained through direct, other face-to-face channels, contract establishment stages, e-mail, text messages, business card sharing, security cameras and all kinds of written, verbal and electronic media.
V. Your Rights Regarding the Protection of Personal Data By applying to the DATA CONTROLLER in accordance with Article 11 of the Law,
To learn whether your personal data is being processed,
Requesting information about it if it has been processed,
To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
To know the third parties to whom personal data is transferred, whether domestically or abroad, and to request correction of personal data if it is processed incompletely or incorrectly,
Request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law,
Request notification of the actions taken in accordance with your above-mentioned rights of correction, deletion and destruction to third parties to whom personal data has been transferred,
To object to any adverse results arising from the analysis of your processed personal data exclusively by automated systems,
To request compensation for your damages in case you suffer damages due to the unlawful processing of your personal data,
You have the rights.

7. OTHER PROVISIONS
7.1. Unforeseen circumstances such as adverse weather conditions, strikes, lockouts, terrorism, military operations, floods, fires, etc., will be considered force majeure. In the event of such circumstances, the hotel may not continue to provide service.
7.2. The hotel reserves the right to change the programs of other special days such as holidays or New Year etc. due to reasons not dependent on the hotel.
7.3. The Customer accepts, declares and undertakes that the Regional Courts have jurisdiction in resolving disputes arising under this contract.
7.4. The Hotel reserves the right to compensate for material and moral costs arising from damage, destruction and/or lost items caused by the Customer in his room and in general areas.
7.5. Customers must not send any goods, items or promotional materials subject to customs clearance on behalf of Hotel employees. The Hotel is not responsible for any customs procedures.
7.6. According to the law, smoking is prohibited in indoor areas of the hotel. These prohibitions will be determined within the framework of the law. Therefore, the use of any kind of cigarettes or tobacco products inside the Hotel is not permitted except in the designated guest rooms.
7.7.This contract will come into effect with the Reservation number given to the Customer by the Hotel after the Customer makes the reservation and payment, and will end when the Customer leaves the Hotel.
DOMESTIC CANCELLATION - CHANGE CONDITIONS
Cancellation is only valid for reservations made for a minimum of 3 nights and a maximum of 14 nights, and the reservation must be made at least 20 days before check-in.
Cancellation does not apply to date or name changes for the same product. Change requests will result in a refund for the existing product. If a new date, product, or name change is requested, a new reservation will be opened and the fee will be charged based on the current conditions.
Domestic Cancellation-Change application is valid for 2020-2021 accommodations.
Cancellations made up to 7 days prior to arrival will be fully refunded. Cancellations made 6 days or less prior to arrival will incur a deduction equal to the cost of a minimum 2-night stay.
